Distribution mass

Money dealt with in the court distribution proceeding after the auction to satisfy eligible claims.

In brief

Definition and context: The distribution mass is the money dealt with in the court distribution proceeding. It is usually documented in the distribution file, filed claims and distribution order. Section 237 of the Enforcement Act narrowly refers to distribution of the highest bid and the finality of the distribution order.

Role question: Creditors must separate the basis of their claim, security and rank. The creditor file matrix sorts those levels, while the creditor checklist supports compilation of the records.

Distinction: The distribution mass is not identical to the highest bid or to one creditor’s payment. Who is taken into account, and for what amount, can only be assessed from the distribution file, land register and order.
